Purpose of data processing

General purpose of processing
We only use your data for the purpose of providing our services. This means that the purpose of processing your data is always directly related to the task you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time – other than at your request – we will ask for your explicit consent.
Your data will not be shared with third parties, other than to comply with accounting and other administrative obligations. These third parties are all bound to secrecy by virtue of the agreement between them and us or an oath or legal obligation.

Automatically collected data
Data automatically collected by our website is processed for the purpose of further improving our services. This data (for example, your IP address, web browser, and operating system) is not personal data.

Cooperation in fiscal and criminal investigations
In cases where required by law, Luxigo may be compelled to share your data in connection with governmental tax or criminal investigations. In such an event, we will be forced to share your data, but we will oppose it to the extent permitted by law.

Retention periods
We retain your data for as long as you are a client of ours. This means we will keep your client profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret it as a request to be forgotten. Due to applicable administrative obligations, we are required to retain invoices with your (personal) data; therefore, we will retain this data for as long as the applicable period lasts. However, employees will no longer have access to your client profile and documents that we have prepared in connection with your assignment.

Your Rights

Under current Dutch and European legislation, as a data subject, you have certain rights regarding the personal data processed by or on behalf of us. We explain below what these rights are and how you can exercise them.

In principle, to prevent misuse, we send copies of your data exclusively to your email address already known to us. Should you wish to receive the data at a different email address or via postal mail, for example, we will ask you to identify yourself. We maintain a record of handled requests; in the case of a forget request, we will keep anonymized data. You will receive all transcripts and copies of data in the data format used within our systems.

You have the right at all times to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you suspect that we are misusing your personal data.

Right of inheritance
You always have the right to access the data that we process (or have processed) concerning you or that can be traced back to you. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data to the email address known to us, along with an overview of the processors who hold this data, stating the category under which we have stored this data.

Right to rectification
You always have the right to have data that we process (or have processed) relating to you or that can be traced back to you, corrected. You can submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation by email that the data has been corrected.

Right to restriction of processing
You always have the right to restrict the processing of data concerning you or that can be traced back to you. You can submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file for you, stating that your data will no longer be processed until you lift the restriction.

Right to transferability
You always have the right to have the data that we process (or have processed) concerning you or that can be traced back to you, transferred by another party. You can submit a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send you copies or duplicates of all data about you that we have processed or that have been processed by other processors or third parties on our behalf, to the email address known to us. In all likelihood, we will no longer be able to continue providing the service in such a case, as the secure linking of data files can no longer be guaranteed.

Right of objection and other rights
In applicable cases, you have the right to object to the processing of your personal data by or on behalf of Luxigo. If you object, we will immediately cease data processing pending the resolution of your objection. If your objection is well-founded, we will make copies of data that we process (or have processed) available to you and then permanently cease processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe that it does, please contact our data protection officer.
